CITY OF COLOMA BERRIEN COUNTY STATE OF MICHIGAN ORDINANCE No. 2019-1 An ordinance to define Parking, Stopping & Standing limitations within the City of Coloma and establish fines for violations of same. THE CITY OF COLOMA ORDAINS: This Ordinance shall be known and cited as Chapter 55 Parking, Stopping & Standing Article I. In General Secs. 55-1 – 55-20 Reserved (a) No vehicle shall be parked on any public street between the hours of 2:30 a.m. and 6:00 a.m., Sunday through Saturday. Sec. 55-22 Reserved Sec. 55-23 Truck Parking (a) No person shall park or leave any truck trailer or semi trailer detached from its truck or tractor on any public street, alley, or city parking lot except in cases of emergency, or with prior written authorization of the police department. Sec. 55-24 Tree Lawn Parking (a) No vehicle shall be parked on any tree lawn in the city except with prior permission of the police department. (b)The words “tree lawn” shall mean the unimproved portion of a street between the roadway and the sidewalk or edge of the street. Sec. 55-25 Parking within lines or markings (a) No person shall park a vehicle in such a manner as to straddle or overlap the limit lines of parking spaces marked upon the street or within any city parking lot. Sec. 55-26. Additional Prohibit Parking (a) The following shall be parking violations within the city: (i) Parking more than 12-inches from the curb or edge of any roadway (ii) Parking on, or allowing a vehicle to hang over, any portion of a public sidewalk (iii) Blocking a public or private drive (iv) Obstructing traffic (v) Parking within 15 feet of a fire hydrant (vi) Parking on or blocking a crosswalk (vii) Parking on the wrong side of the street facing oncoming traffic (viii) Double parking (ix) Parking in or blocking a fire lane (x) Parking in or blocking a designated bike lane (xi) Blocking or impeding a fire escape route or exit (xii) Parking in front of a theatre (xiii) Parking to display a vehicle for sale (b)Parking in a prohibited zone where signs are erected. (c)Parking for more than two hours in any space where a two-hour maximum is designated and signs are erected. (d) Unlawful parking in any space marked as handicapped only. (e) Any vehicle parked in violation of this section may be towed to some other place an authorized agent or servant of the city, in which event the owner of such vehicle shall be charged for all towing fees and storage charges in addition to any other penalty imposed by or under this code. Sec. 55-27. Towing of Vehicles (a) Any vehicle parked in violation of this Chapter may be towed to some other place by an authorized agent or servant of the city, in which event the owner of such vehicle shall be charged for all towing fees and storage charges in addition to any other penalty imposed by or under this code. Sec. 55-28 Presumption of Ownership (a)Generally whenever a police officer shall observe a violation of an ordinance pertaining to parking, he or she may issue a parking violation notice. The parking violation notice shall direct the owner of the vehicle to pay a fine at the office of the city clerk in the city hall. Such person shall then pay the sum of $5.00, if such fine is paid by the end of the next business day after such notice is dated. Thereafter, the scheduled fine shall increase in the manner set forth below: i. Fine 3-15 days $15.00 ii. Fine 16-30 days $20.00 iii .Fine after 30 days $25.005.00 (b)Handicapped Parking Violations. The fines above shall not apply to handicapped parking violations. The fine for such violations shall be $100.00, if such fine is paid by the end of the next business day after such notice is dated. i. Fine 3-15 days $130.00 ii. Fine 16-30 days $140.00 iii. Fine after 30 days $150.0015 day Sec. 55-30 Interference with enforcement of parking ordinances and regulations (a)No person shall interfere with or hinder the enforcement of the parking, standing or stopping ordinances and regulations of the City of Coloma by removing, erasing, altering, concealing or in any manner modifying any tags, stickers, chalk, or other marks or symbols place on a vehicle by a police officer, or by any other act designed or intended to prevent such enforcements. (b)Violation of this section shall be a misdemeanor. Sec. 55-31 Unpaid parking violations; towing of vehicle (a)No person shall park a vehicle on any street or public parking lot if the vehicle’s owner has failed to answer six or more parking violation notices or citations regarding illegal parking. For the purposes of the section, and “answer” shall be defined as taking either of the following actions within five days of the issuance of the parking violation notice or citation: (i) paying the appropriate fine, or (ii) giving the city police department written documentation that the citation is contested. (b)Any vehicle parked in the violation of this section may be towed to some other place by a licensed towing service registered with the city upon direction of any police officer or other authorized agent or servant of the city, in which event the vehicle shall not be released until all accrued fines are paid in full, and the owner of such vehicle shall have paid all towing fees and storage charges.
