TOWNSHIP OF BANGOR COUNTY OF VAN BUREN, STATE OF MICHIGAN ORDINANCE NO. 24 ADOPTED: February 12, 2019 EFFECTIVE: March 12, 2019 PROHIBITION OF RECREATIONAL MARIHUANA ESTABLISHMENTS ORDINANCE An ordinance to provide a title for the ordinance; to define words; to prohibit marihuana establishments within the boundaries of Bangor Township pursuant to Initiated Law 1 of 2018, MCL 333.27951 et seq., as may be amended; to provide penalties for violation of this ordinance; to provide for severability; to repeal all ordinances or parts of ordinances in conflict therewith; and to provide an effective date.

THE TOWNSHIP OF BANGOR VAN BUREN COUNTY, MI ORDAINS: SECTION I TITLE This ordinance shall be known as and may be cited as the Bangor Township Prohibition of Recreational Marihuana Establishments Ordinance.

SECTION II DEFINITIONS Words used herein shall be the definitions as provided for in Initiated Law 1 of 2018, MCL 333.27951 et seq., as may be amended. A recreational marihuana establishment is defined as establishment that distributes or sells marihuana, or a place where marihuana is exchanged, sold, smoked. SECTION III NO MARIHUANA ESTABLISHMENTS Bangor Township hereby prohibits all recreational marihuana establishments within the boundaries of the Township pursuant to Initiated Law 1 of 2018, MCL 333.27951 et seq., as may be amended. SECTION IV VIOLATIONS AND PENALTIES Any person who disobeys, neglects or refuses to comply with any provision of this ordinance or who causes, allows or consents to any of the same shall be deemed to be responsible for the violation of this ordinance. A violation of this ordinance is deemed to be a nuisance per se. A violation of this ordinance is a municipal civil infraction, for which the fines shall not be less than $100 nor more than $500, in the discretion of the Court. The foregoing sanctions shall be in addition to the rights of the Township to proceed at law or equity with other appropriate and proper remedies. Additionally, the violator shall pay costs which may include all expenses, direct and indirect, which the Township incurs in connection with the municipal civil infraction. Each day during which any violation continues shall be deemed a separate offense. In addition, the Township may seek injunctive relief against persons alleged to be in violation of this ordinance, and such other relief as may be provided by law. This ordinance shall be administered and enforced by the Ordinance Enforcement Officer of the Township or by such other person (s) as designated by the Township Board from time to time. SECTION V SEVERABILITY The provisions of this ordinance are hereby declared to be severable. If any clause, sentence, word, section or provisions is hereafter declared void or unenforceable for any reason by a court of competent jurisdiction, it shall not affect the remainder of such ordinance which shall continue in full force and effect. SECTION VI REPEAL All ordinance or parts of ordinance in conflict herewith are hereby repealed. PROHIBITION OF MEDICAL MARIHUANA ESTABLISHMENTS ORDINANCE An ordinance to provide a title for the ordinance; to prohibit medical marihuana establishments within the boundaries of Bangor Township; to provide penalties for violation of this ordinance; to provide for severability; to repeal all ordinances or parts of ordinance in conflict therewith; and to provide an effective date. THE TOWNSHIP OF BANGOR VAN BUREN COUNTY, MICHIGAN ORDAINS:

SECTION I TITLE This ordinance shall be known as and may be cited as the Bangor Township Prohibition of Medical Marihuana Establishments Ordinance. SECTION II NO MEDICAL MARIHUANA ESTABLISHMENTS The State of Michigan enacted the Medical Marihuana Facilities Licensing Act, MCL 333.27101 et. Seq., to license and regulate certain commercial entities identified in the Act as growers, processors, provision centers, secure transporters, and safety compliance facilities. The Medical Marihuana Facilities Licensing Act provides, in MCL 333.27205, that a medical marihuana facility shall not operate in a municpality unless the municpality has adopted an ordinance that authorizes that type of facility. Bangor Township Board has decided to NOT adopt an ordinance to authorize the location of any marihuana facilities within the Township of Bangor. Bangor Township hereby prohibits all marihuana establishments within the boundaries of the Township. BANGOR TOWNSHIP PUBLIC NOTICE ORDINANCE NO. 26 CONSUMERS ENERGY COMPANY GAS AND/OR ELECTRIC FRANCHISE ORDINANCE AN ORDINANCE, granting to CONSUMERS ENERGY COMPANY, its successors and assigns, the right and authority to lay, maintain and commercially operate gas lines and facilities including but not limited to mains, pipes, services and valves and to construct, maintain and commercially use electric lines and related facilities including but not limited to towers, masts, poles, crossarms, guys, wires and transformers on, under, along, and across public places including but not limited to highways, streets, alleys, bridges, and waterways, and to conduct a local gas and/or electric business in the TOWNSHIP OF BANGOR, VAN BUREN COUNTY, MICHIGAN, for a period of thirty years. THE TOWNSHIP OF BANGOR ORDAINS: SECTION 1. GRANT and TERM. The TOWNSHIP OF BANGOR, VAN BUREN COUNTY, MICHIGAN, hereby grants to Consumers Energy Company, its successors and assigns, hereinafter called “Consumers” the right and authority to lay, maintain and commercially operate gas lines and facilities including but not limited to mains, pipes, services and valves and to construct, maintain and commercially use electric lines and related facilities including but not limited to towers, masts, poles, crossarms, guys, wires and transformers on, under, along. and across public places including but not limited to highways, streets, alleys, bridges, and waterways, and to conduct a local gas and/or electric business in the TOWNSHIP OF BANGOR, VAN BUREN COUNTY, MICHIGAN, for a period of thirty years. SECTION 2. CONDITIONS. No public place used by Consumers shall be obstructed longer than necessary during construction or repair, and shall be restored to the same order and condition as when work was commenced. All of Consumers’ gas lines, electric lines and related facilities shall be placed as not to unnecessarily interfere with the public’s use of public places. Consumers shall have the right to trim or remove trees if necessary in the conducting of such business. SECTION 3. HOLD HARMLESS. Consumers shall save the Township free and harmless from all loss, costs and expense to which it may be subject by reason of the negligent construction and maintenance of the lines and related facilities hereby authorized. In case any action is commenced against the Township on account of the permission herein given, Consumers shall, upon notice, defend the Township and its representatives and hold them harmless from all loss, costs and damage arising out of such negligent construction and maintenance. SECTION 4. EXTENSIONS. Consumers shall construct and extend its gas and/or electric distribution system within said Township, and shall furnish gas and electric service to applicants residing therein in accordance with applicable laws, rules and regulations. SECTION 5. FRANCHISE NOT EXCLUSIVE. The rights, power and authority herein granted, are not exclusive. SECTION 6. RATES and CONDITIONS. Consumers shall be entitled to provide gas and electric service to the inhabitants of the Township at the rates and pursuant to the conditions as approved by the Michigan Public Service Commission. Such rates and conditions shall be subject to review and change upon petition to the Michigan Public Service Commission. SECTION 7. REVOCATION. The franchise granted by this ordinance is subject to revocation upon sixty (60) days written notice by either party. Upon revocation this ordinance shall be considered repealed and of no effect past, present or future. SECTION 8. MICHIGAN PUBLIC SERVICE COMMISSION JURISDICTION. Consumers remains subject to the reasonable rules and regulations of the Michigan Public Service Commission applicable to gas and electric service in the Township and those rules and regulations preempt any term of any ordinance of the Township to the contrary.. SECTION 9. REPEALER. This ordinance, when enacted, shall repeal and supersede the provisions of any previous gas and/or electric franchise ordinance adopted by the Township including any amendments. SECTION 10. EFFECTIVE DATE. This ordinance shall take effect on 30 days after publication.
