THE CITY OF WATERVLIET ORDAINS
ORDINANCE NO. 2016 -2
AN ORDINANCE TO SECURE THE PUBLIC PEACE, HEALTH AND SAFETY OF THE RESIDENTS AND PROPERTY OWNERS OF THE CITY OF WATERVLIET, BERRIEN COUNTY, MICHIGAN, A MUNICIPAL CORPORATION, FOR THE REGULATION OF THE USE OF GOLF CARTS ON ROADS WITHIN THE LIMITS OF THE CITY, THE PROHIBITION OF THE USE OF GOLF CARTS ON STATE TRUNK LINES PURSUANT TO MCL 257.657a, TO PROVIDE PENALTIES FOR THE VIOLATION OF SAID ORDINANCE, AND TO REPEAL ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT THEREWITH.
Section 1.
This Ordinance shall be known and cited as the City of Watervliet Golf Cart Regulation Ordinance.

Section 2
A person may operate a golf cart on City roads within the City of Watervliet subject to the following restrictions:
A person shall not operate a golf cart unless he or she is at least 16 years old and licensed to operate a motor vehicle.
The operator of a golf cart shall comply with the signal requirements of MCL 257.648 that apply to the operation of a vehicle.
A person operating a golf cart upon a roadway shall ride as near to the right side of the roadway as practicable, exercising due care when passing a standing vehicle or one proceeding in the same direction.
A person shall not operate a golf cart on a state trunk line highway (including M-140 and Red Arrow Highway). This subsection does not prohibit a person from crossing a state trunk line highway when operating golf carts on a public street using the most direct line crossing.
Where a usable designated path for golf carts is provided adjacent to a highway or street, a person operating a golf cart shall be required to use that path.
A person operating a golf cart shall not pass between lines of traffic, but may pass on the left of traffic moving in his or her direction in the case of a two-way street or on the left or right of traffic in the case of a one-way street, in the occupied lane.
A golf cart shall not be operated on a sidewalk constructed for the use of pedestrians.
A golf cart shall be operated at a speed not to exceed 15 miles per hour and shall not be operated on a highway or street with a speed limit of more than 30 miles per hour except to cross that highway or street.
A golf cart shall not be operated on public streets during the time period from one-half (1/2) hour before sunset to one-half (1/2) hour after sunrise.
A person operating a golf cart or who is a passenger in a golf cart is not required to wear a crash helmet.
This ordinance does not apply to a police officer in the performance of his or her official duties.
A golf cart operated on a public street under this ordinance is not required to be registered under the Michigan Vehicle Code for purposes of section 3101 of the insurance code of 1956, 1956 PA 218, MCL 500.3101.
As used in this ordinance, “golf cart” means a vehicle designed for transportation while playing the game of golf. A golf cart is not required to meet the vehicle safety requirements of a low speed vehicle for approval under this ordinance.
Section 3
Any person found guilty of violating any provisions of this Ordinance shall be guilty of a misdemeanor and punished in accordance with Watervliet City Ordinance Sec. 1-7. – General penalty; continuing violations.
THIS ORDINANCE WILL TAKE EFFECT ON NOVEMBER 1, 2016
