NOTICE OF PUBLIC HEARING

TO THE RESIDENTS AND PROPERTY OWNERS OF THE CHARTER TOWNSHIP OF WATERVLIET, BERRIEN COUNTY, MICHIGAN AND ALL OTHER INTERESTED PERSONS:

BE IT HEREBY NOTICED that the Watervliet Charter Township Zoning Board of Appeals will conduct a public hearing on Wednesday December 16, 2020 at 2:00 p.m. at the Watervliet Charter Township Hall 4959 M-140 Highway, Watervliet, Michigan. The hearing is called at the request of Gregg and Cynthia Todd for property they own on Lake Ave. directly across the street from their home located at 8318 Lake Ave. The property numbers for the specific site are: 11-21-2220-0265-00-0 & 11-21-2220-0266-00-6.

The Todds have recently made the home their primary residence and would like to construct a 2 vehicle garage for parking and storage as an accessory use. The requested garage would be placed on lots 265 & 266, however, the combined total square footage of the two lots is 3,111.5 square feet. The accessory use they are requesting is 35’X 25’comprising a square footage of 875 square feet. The structure, as proposed on the two lots, would have a front setback distance from the frontage on Lake Ave. of 15 feet and have a rear yard setback of 10.5 feet. Designed placement would maintain required side yard setbacks of at least 10 feet.

Watervliet Charter Township Zoning Ordinance No. 77, Article V, Section 5.12 – Schedule of District Regulations – Yard, Height and Lot Size Requirements for Principal and Accessory Uses; mandates a front yard (roadside) setback in this district of 35 feet and a rear yard setback of 25 feet. As such, a dimensional variance from the front setback of 20 feet and a rear yard setback variance of 14.5 feet would have to be granted for this structure to be built as requested.

All interested parties are invited to attend the hearing to voice concerns, comment on the matter or become informed. Written correspondence will be accepted either by mailing to the Watervliet Charter Township Hall 4959 M-140 Hwy., Watervliet, MI. 49098; faxed to (269) 463-4808; e-mailed to watervliettownship@yahoo.com or personally delivered to the attention of the Zoning Administrator. Hand delivered correspondence will be received any time prior to or during the hearing and all correspondence will be read into the record.

PLEASE TAKE FURTHER NOTICE that Watervliet Charter Township will provide necessary and reasonable auxiliary aids and services, such as signers for the hearing impaired and audio tapes of printed material being considered at the hearing upon six (6) business days notice by contacting the Office of Zoning Administration at the above address or by phoning (269) 463-5113. Be further advised that all CDC guide lines relating to Covid-19 will be in place, such as the requirement of face coverings, social distancing and a limitation of people permitted in the meeting room at one time.
