NOTICE OF ADOPTION OF ORDINANCE 45-B Short-Term Rental Registration Ordinance as amended.


TO THE RESIDENTS AND PROPERTY OWNERS OF BAINBRIDGE TOWNSHIP,

BERRIEN COUNTY, MICHIGAN, AND ANY OTHER INTERESTED PERSONS:

Please take notice that the following is a summary of Ordinance No.45B which was adopted by the Bainbridge Township Board at a regular meeting held on the 13th day of February 2023.

This ordinance shall be known as and may be cited as the Bainbridge Township Short-Term Rental Registration Ordinance.

Section 1. DEFINITIONS. Words used herein shall have the definitions as provided for in Initiated Law 1 of 2018, MCL 333.27951 et seq., as may be amended.

Section 2. REGISTRATION AND PERMIT REQUIRED. Bainbridge Township hereby prohibits all Short-Term Rentals within the boundaries of the Township without having first obtained a registration permit, pursuant to Initiated Law 1 of 2018, MCL 333.27951et seq., as may be amended.

Section 3. APPLICATION AND CONTENTS. This section sets out the required information for an application.

Section 4. APPLICATION, FEE FILING PROCEDURE, PERMIT. An application for a Short-Term Rental Registration Permit shall be accompanied by an application fee.

Section 5. SHORT-TERM RENTAL REGULATIONS. All Short-Term Rentals shall comply with the regulations of this section.

Section 6. NONTRANSFERABLE. No registration permit issued under the provision of this ordinance shall be transferable.

Section 7. SUSPENSION AND REVOCATION. Short-Term Rental registration may be revoked by the Township Board as allowed for in this section.

Section 8. GROUND FOR SUSPENSION AND/OR REVOCATION. This section lays out the grounds for suspension or revocation of a registration permit.

Section 9. REVOCATION PROCEDURE. This section explains the procedure for revocation of a registration permit.

Section 10. RENEWAL OR REVOKED PERMIT RESTRICTED. This section provides for a maximum revocation period.

Section 11. REGISTRATION PERMITS MUST BE IN EFFECT. This section places the responsibility of the registrant to verify all requirements are lawfully in effect prior to business operation.

Section 12. PENALTIES. This section explains the duties of the Ordinance Enforcer and administration and enforcement procedures including violations and penalties for violation

Section 13. REPEAL OF CONFLICTING ORDINANCES. All ordinance or parts of ordinances in conflict herewith are hereby repealed.

Section 14. SEVERABILITY. The provisions of this ordinance are declared to be severable and if any clause is declared void or unenforceable, it shall not affect the remainder of the ordinance.

Section 15. EFFECTIVE DATE. This ordinance shall take effect 30 days following publication.

Section 16. ADOPTION. This section is the date of adoption.

PLEASE TAKE FURTHER NOTICE that the full text of this Ordinance has been posted in the Office of the Bainbridge Township Clerk at the address set forth below and that a copy of the Ordinance may be purchased or inspected at the office of the Township Clerk during regular business hours of regular working days of the Township following the date of this publication.
