NOTICE OF PUBLIC HEARING ON THE

SPECIAL ASSESSMENT ROLL FOR 2020-2024 ROUND LAKE

AQUATIC WEED CONTROL SPECIAL ASSESSMENT DISTRICT

TO: THE RESIDENTS AND PROPERTY OWNERS OF KEELER TOWNSHIP, VAN BUREN COUNTY, MICHIGAN, OWNERS OF LAND WITHIN THE 2020-2024 ROUND LAKE AQUATIC WEED CONTROL SPECIAL ASSESSMENT DISTRICT AND ANY OTHER INTERESTED PERSONS:

PLEASE TAKE NOTICE that the Township Supervisor and Assessor have prepared and filed in the office of the Township Clerk for public examination a special assessment roll covering all properties within Round Lake Weed Control Special Assessment District 2020 benefited by the proposed weed control project. The roll has been prepared for the purpose of assessing the costs of the project within the aforesaid district, as more particularly shown by the plans on file with the Township Clerk. The costs of the project are as shown on the estimate of costs on file with the Township Clerk.

PLEASE TAKE FURTHER NOTICE that the special assessment amounts are assessed on a per parcel basis. The Supervisor and Assessor have further reported to the Township Board that the assessment against each parcel of land within said district is such relative portion of the whole sum levied against all parcels of land in said district as the benefit to such parcels bears to the total benefit to all parcels of land in said district.

PLEASE TAKE FURTHER NOTICE that the Township Board will meet at the Keeler Township Hall, 64121 Territorial Road W, Hartford, MI 49057 on Tuesday, August 11, 2020 at 7:30 p.m. for the purpose of reviewing the special assessment roll and hearing any objections thereto. After the public hearing, the Township Board may confirm the roll as submitted or as revised or amended. The roll may be examined by contacting the Township Clerk at (269) 621-6481 or via email at keeler@cybersol.com during regular business hours of regular business days until the time of the hearing and may further be examined at the hearing. *Please take notice that the Keeler Township Office is open only limited hours during COVID-19 health crisis and under executive orders of the Michigan Governor. You may be asked to make an appointment to examine the roll or have it emailed to you for inspection. Additionally, the Township Board anticipates that the hearing will be held in-person at the township hall; however further orders from the Michigan Governor may require a video-conference or teleconference. Please check the township’s website at www.keelertownship.org for information.

PLEASE TAKE FURTHER NOTICE that appearance and protest at this hearing is required in order to appeal the amount of the special assessment to the State Tax Tribunal. Please also note that an owner or party in interest, or his or her agent, may appear in person at the hearing to protest the special assessment in writing, or may file his or her appearance and protest by letter before the hearing, and in that event, personal appearance shall not be required. The owners or any person having in interest in the real property who protests in writing at or before the hearing may file a written appeal of the special assessment with the State Tax Tribunal within 30 days after confirmation of the special assessment roll.

PLEASE TAKE FURTHER NOTICE that if the special assessment roll is confirmed, the Township Board intends to hold a public hearing once each year in future years to reassess property in the special assessment district for the costs in the next year, and will provide notice of such hearing by publication in the newspaper only, unless the amount to be specially assessed increases by more than 10 percent in any one year. If the amount to be specially assessed increases by more than 10 percent in any one year, then mailed notice of the public hearing will be provided to owners of property to be specially assessed. The Township Board specifically reserves the right not to levy an assessment in any year or to levy a lesser assessment amount in any year that there are more funds in the special assessment fund than the amount needed for that year’s weed control work and associated activities.

Keeler Township will provide necessary, reasonable auxiliary aids and services such as signers for the hearing impaired and audio tapes of printed material being considered at the meeting to individuals with disabilities at the meeting upon four (4) days’ notice to the Keeler Township Clerk. Individuals with disabilities requiring auxiliary aids or services should contact the Keeler Township Clerk at the address or telephone number listed below.

** Please take notice that prior orders of the Michigan Governor temporarily suspended provisions of the Open Meetings Act to permit video and/or teleconferencing for public meetings. Those orders have not been extended past July 31, 2020, but they may be. Please check the Township’s website at www.keelertownship.org to determine whether the video/teleconferencing option has been extended and if so, how to attend the meeting virtually.
